- Order and Price
1.1. The price of the Goods shall be the price ruling at the date of the sale transaction and shall be exclusive of tax, delivery and handling charges (if any) and expenses including during transit which the buyer shall be additionally liable to pay to The Name Hut.
1.2. No order may be cancelled by the buyer without the written consent of The Name Hut which shall only be given on terms that the Buyer shall indemnify The Name Hut in full against all loss (including loss of profit), costs (including cost of labour and materials used), damages, charges and expenses incurred by The Name Hut as a result of such cancellation.
- Description
2.1. Any description given or applied to the Goods is given by way of identification only and the use of such description shall not constitute a sale by description. For the avoidance of doubt, the Buyer hereby affirms that it does not in any way rely on any description when entering into the contract. In respect to bespoke goods The Name Hut reserves the right to interpret the Buyer's instructions to suit the method of manufacture. This includes the interpretation of relief work and the painting and/or manufacturing of the article or articles commissioned.
- Sample
3.1. Where a sample of the Goods is shown to and inspected by the Buyer, the parties hereto accept that such a sample is so shown and inspected for the sole purpose of enabling the Buyer to judge for itself the quality of the bulk, and not so as to constitute a sale by sample.
- Delivery/shipping
4.1. Unless otherwise agreed in writing, delivery of the Goods shall take place at the address specified by the Buyer on the date specified by the carrier and/or The Name Hut. The Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.
4.2. The date of delivery specified by the carrier and/or The Name Hut is an estimate only. Time for delivery shall not be of the essence of the contract.
4.3. If The Name Hut is unable to deliver the Goods for reasons beyond its control, then The Name Hut shall be entitled to place the Goods in storage until such times as delivery may be effected and the Buyer shall be liable for any expense associated with such storage.
4.4. The Buyer shall be entitled to replacement Goods where the Goods have been damaged during transportation. The Buyer must notify The Name Hut of the damage within 24 hours of delivery all packaging material must be retained for inspection. When the goods are received from the carrier they should be inspected before the bill-of-lading is signed “the goods are received in good condition.” If the goods are found to be damaged upon inspection then the carrier's bill-of-lading should be signed as "damaged".
4.5. On any shipping beyond the boundaries of the United States of Americas, the Buyer understand that The Name Hut is not liable for any acts of officials and/or workers handling the items at destination, Every nation has customs laws and import procedures inherent to that country, and The Name Hut does not pretend to have any knowledge of them. It is the Buyer responsibility to inform himself and act accordingly.
4.6. For deliveries within the continental USA on orders weighing one (1) lb or less, The Name Hut will reserve the right to use USPS regular when the cost of UPS Ground is higher than the shipping fee being charged.
- Shipping Cost
5.1. For UPS Ground within the continental USA, rates are estimated by weight of articles being shipped, all in one (1) package only.
5.2. Sales over US$95.00 ($95.01 and higher) will be free of shipping charges (UPS Gound only) This shall be true and hold for normal purchases that will exclude certain large, bulk and/or custom orders where a special price has been convened, The Name Hut deciding the shipping charges for these cases.
- Warranty
6.1. Subject to payment for the goods having been made in full The Name Hut warrants that the Goods will correspond with any agreed specification (subject to 1.1 above) and will be free from defects caused by reason of faulty materials or workmanship for a period of 20 days from delivery. In the event of any such defects arising during such period, The Name Hut will repair such defects or replace defective Goods free of charge subject to the Buyer notifying The Name Hut in writing immediately upon the defect becoming apparent. The Name Hut makes no warranty that the Goods will be fit for any particular purpose even where that purpose has been disclosed to The Name Hut.
6.2. Any Goods to be repaired or replaced shall be returned to The Name Hut at the Buyer’s expense, if so requested by The Name Hut.
6.3. Where the Goods have been manufactured and supplied to The Name Hut by a third party, any warranty granted to The Name Hut in respect of the Goods shall be passed on to the Buyer.
6.4. The Name Hut shall be entitled in its absolute discretion to refund the price of the defective Goods in the event that such price has already been paid. The refund will exclude shipping and handling charges.
- Force Majeure
7.1. The Name Hut shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and The Name Hut shall be entitled to a reasonable extension of its obligations. If the delay persists for such time as The Name Hut considers unreasonable, it may, without liability on its part, terminate the contract.
- Privacy
8.1 We do not collect any personal information upon a visit to our web page, except when the contact-us is used or an order is placed. Also, the Name Hut does not pass any information to third parties, associated or not to The Name Hut.
- Jurisdiction
9.1. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida and the United States of America and the parties hereby submit to the exclusive jurisdiction of these courts.
